Introduction

Welcome to BizBuzz! By accessing or using the BizBuzz app or website, you agree to comply with these Terms and Conditions as well as the Privacy Policy. "BizBuzz" refers collectively to both the BizBuzz app and all BizBuzz website/s. If you do not agree with any of these terms, please discontinue your use of BizBuzz immediately.

BizBuzz reserves the right to modify any of the terms of this agreement at any time without notification that a modification has occurred. BizBuzz users are responsible to review these Terms and Conditions from time to time to ensure that they are knowledgeable with the most updated version.

1. General Disclaimer

BizBuzz is a listing service platform only and is not liable for any direct or indirect consequences arising from inaccuracies or activities related to any business or person or their profiles, including but limited to: hours of operation, services provided, address location, any information in the profile or listing, offer/s, job posting/s, messages, conversations, or other content displayed on or using BizBuzz. While BizBuzz encourages community efforts to flag inappropriate or inaccurate content, it does not guarantee the timely removal of such content. Users are solely responsible for verifying the accuracy of information on BizBuzz before making any business or personal decisions, and BizBuzz is not responsible for conducting background checks or verifying credentials of any listings or profiles. BizBuzz is not responsible or liable for the actions of its users, businesses or members that use BizBuzz.

2. Indemnification

By using BizBuzz, users agree to conduct their own research before engaging with businesses listed on the platform and hereby indemnify BizBuzz, its employees, owners, contractors and associated vendors from any liability associated with interactions arising from BizBuzz's listings or with BizBuzz users. Users are solely responsible for any risks associated with their use of BizBuzz.

3. Advertising Revenue Disclosure

BizBuzz rewards users for referrals by sharing a portion of the certain advertising revenue, considered “Qualified advertising revenue”, spent by businesses within their referral network up to five levels deep. When a new user joins via a referral code or invitation link, the user and their businesses on BizBuzz become part of the referrer’s Level 1 network. Although a User can be invited by numerous BizBuzz users, that user can only be considered a Level 1 to just one user and it is based on the specific link that user chooses to use when they successfully set up their account on BizBuzz. All businesses of that Level 1 that are registered/claimed on BizBuzz also become Level 1 businesses to the referrer of the link that was used to by the Level 1 user to set up their BizBuzz personal account. When a Level 1 user invites another user to BizBuzz and that user sets up an account on BizBuzz, that new user and all their businesses become the Level 2 to the referrer of the Level 1 person. This continues up through Level 5 as the network expands up to five levels, with each level’s businesses generating potential revenue to all 5 levels above those businesses. By advertising on BizBuzz, businesses acknowledge and agree that their net advertising revenues may be disclosed to users up to five levels above them. All revenues of businesses located on each level are combined into one revenue amount for display purposes for the referrers in that network up to 5 levels above of each business. Individual purchases of a business or details about those purchases are not shared, just the combined revenue amount for any time period selected by user for all business advertising spent in each level. So if 5 companies in Level 2 had combined revenues of $1000 from qualified advertising revenue during a specific time period that total revenue number would be displayed to the user. It is understood that a user up to 5 levels above them could potentially determine how much revenue their business is spending on BizBuzz if they were the only business in one of the specific 5 levels of that user or if that user had any inside knowledge of what the other businesses were spending in that user’s level. See #13 below for further information regarding commissions on advertising revenues within a user’s network.

4. Offers (Intro, BizBuzz, and Daily Offers)

  • Offer Creation and Responsibility: BizBuzz suggests to make offers as enticing as possible with as little limitations as possible to provide the best overall response and positive experience for BizBuzz users. Businesses are responsible for making their offers clear and not misleading. BizBuzz may, at its sole discretion, may remove offers if they receive complaints of any kind or appear misleading. BizBuzz at its discretion, also reserves the right to require business to change their offer or have offer completely removed to be in compliance but BizBuzz is not required to do so and may just remove the offer without a credit. BizBuzz does not provide any refunds or partial refunds to businesses for offers that have been removed.

  • Download Limits and Refund Policy: BizBuzz offers require upfront payment based on a specified number of downloads. BizBuzz does not guarantee any individual offer will be downloaded and no refunds or partial refunds are provided regardless of the number of downloads or lack of downloads no matter the number of downloads. Pausing an offer does not entitle the business to any form of credit or refund.

  • 180 Day time period: Unless otherwise a specified, a set of purchased downloadable BizBuzz offers are only good for 180 days from the time the business purchases the offers. Pausing the offers does not increase or add more days to this 180-day period. If BizBuzz at its sole discretion, does not discontinue the offers after 180 days and extends the time period, BizBuzz is not required to notify the business of this extension and BizBuzz is not responsible for any consequential damages and businesses are solely responsible for honoring any offers still being shown on the business’s profile and in daily offers. Businesses at any time can pause their offers but must honor any that users have already downloaded that have not expired for that user. If BizBuzz at its own discretion extends the Offer period over 180 days, BizBuzz can at any time after the 180 days discontinue the Offer.

  • Offer Honoring: Businesses agree to honor offers as presented at the time the user downloads the offer, even if changes were later made to the terms of that offer. Currently making changes after purchasing a set of downloadable offers is not a feature on BizBuzz.

  • Daily Offers: This section of the app showcases around the viewer’s area or selected location the most popular downloads of the offers, with most popular offers shown near the top of page based on the number of downloads during the past 30 days. BizBuzz reserves the right without notice or disclosure to have other factors influence which BizBuzz offer appears at top of page.

  • No refunds or changes allowed: Businesses are encouraged to double-check that everything in their offer is correct before posting. BizBuzz Offers can only be paused, but not edited, once purchased and no refunds or partial refunds are given for unused portions of offers. Businesses if they want changes to their offer must create and pay for new offers. Currently Intro Offers can be changed after posting however BizBuzz reserves the right to limit or restrict changes in the future.

  • Intro offers Currently BizBuzz has a special promotion where a business can add an Intro Offer for 12 months from the time the business is claimed or after a new business is added to BizBuzz through an advertising credit that covers the standard $125 monthly cost so the business does not have to pay extra during that time period. If that business does not cancel the Intro Offer prior to the end of this initial 12 month period, a $125 charge to the business starting the first day of month 13 of the Intro Offer may be charged to the payment method that is on file at that time. BizBuzz reserves the right to modify or end this promotion at any time.


5. Job Postings / Job Openings

  • Accuracy and Authenticity: BizBuzz is not responsible for the accuracy or authenticity of job postings. Businesses must ensure postings are not misleading.

  • Caution for Users: Users should never share sensitive personal information or pay fees when applying for jobs listed on BizBuzz. Use discretion and avoid interviews in any private or unsafe locations. Unfortunately, there are many unscrupulous individuals and businesses in the world, and it is highly recommended that users conduct their own research and own due diligence before meeting or conducting business with others. BizBuzz is not responsible for any losses incurred by users that fall subject to scams or releasing of personal data to others using BizBuzz.

  • No Refunds: Job postings are charged upfront, are non-refundable, and automatically renew monthly unless paused before the renewal date. BizBuzz is not responsible for any overlooked renewals.

  • Rates increase: It is understood that from time to time BizBuzz at its own discretion may increase rates on job postings. These rate increases may go into effect after 30 day notice. The method of delivery of these notices are at the discretion of BizBuzz and may be given via email or via text to the business or authorized representative of that business, or through BizBuzz’s own messaging inside the app or website to the business or the authorized representative of that business. BizBuzz is not responsible for users overlooking their emails, messages or notices and no refunds or partial refunds will be given if a user misses an email.

6. Category Zip Code Campaigns

  • Bidding and Ranking: Businesses may bid for weekly campaigns within specific zip codes to boost visibility in search results within their category. BizBuzz’s ranking algorithm considers bid amount, download popularity, ratings, and proximity. Although having the highest bid of a category in a zip code is one of the heaviest weighted factors in determining which business in that category and zip code will rank higher, other factors do influence ranking and top placement is not guaranteed. Further, it is understood that bidding is fluid and at any point other companies in that category may increase their BizCategory bid for a particular zip code or multiple zip codes. Users agree that it is solely their responsible to view top bids for their categories by viewing or editing their campaign and it is recommended to periodically check top bids to see how well their current zip code bids compare to the top bid. No refunds or partial refunds are given to those businesses for bids that were once top or high bids compared to other competing businesses, but then were later ranked lower due to other competing companies.

  • Starting bid: For those categories that do not have an initial bid in that zip code, BizBuzz assigns a minimum weekly top bid as a base for starting purposes.

  • Renewal and Refunds: By setting up a BizCategory campaign, the user agrees and acknowledges that their campaign/s will automatically renew unless paused and user agrees to the charges associated with that renewal and no renewal notice is required to be sent out or seen by the viewer. Campaigns auto-renew weekly and are non-refundable once purchased. Changes can be made to campaigns, but no partial refunds apply for a billing period that was already charged. If a User reduces their overall campaign spend, the changes will be immediate regarding the advertising reach and placement within the search results, but the new lower weekly campaign price will not take place until the start of the new weekly renewal cycle. If a user increases their overall campaign spend, the incremental increase will be charged for the remaining number of days out of the 7 day week advertising period, and that new increased price will be the new renewal weekly payment.

7. Monthly Membership fees – Currently BizBuzz does not have a monthly fee for a business to have a registered/claimed standard business profile. BizBuzz reserves the right with 30-day notice to implement a monthly fee to be listed on BizBuzz. The method of delivery for this notice for this fee is at BizBuzz’s sole discretion and will consist of at least 2 notices. These notices may be delivered via email, text or BizBuzz message to the business and/or personal user and it is at the discretion of BizBuzz on how, what method of delivery or timing these messages are delivered. Any subsequent increases to these monthly membership fees may also be done by BizBuzz as per similar method described in this paragraph.

8. Business Categories and Location Accuracy

  • Category Selection: Businesses should only select relevant categories. Businesses that choose inappropriate category choices may result in removal of that business from BizBuzz and possible other businesses/locations associated with that business or owner and/or be subject to reentry fees to get back on BizBuzz.

  • Location and Duplicate Listings: Accurate business locations are required. BizBuzz has strict penalties for creating fake locations, fake names, businesses or duplicate addresses and may impose re-entry fees or bans for that user or business and also for any current or future businesses associated with that user.

9. Unauthorized Business Claims or False or Fake profiles

Only authorized representatives may claim a business profile on BizBuzz. Claiming a business without authorization may result in legal consequences.

BizBuzz may release account details or any information it may have to third parties or authorities if fraudulent claims of businesses or false personal or business profiles are suspected.

10. Friendship, Blocking, Messaging, and Privacy

Users should exercise caution when friending or messaging others and avoid sharing sensitive, financial or personal information. While users may block or restrict others, BizBuzz is not liable for any technological glitches that affect these functions. Further blocking a user or deleting data on one’s own user account will not remove any messages or conversations from the other user’s account, nor does it remove buzzworthy posts that the user may appear or be tagged in and does not remove possible cache or saved data that another user may have stored in their device.

11. GPS and Third-Party Mapping Services

BizBuzz uses third-party mapping services, but is not liable for inaccuracies in location, mapping, or directions provided by these services. Users are responsible for monitoring what access they give to the BizBuzz or third-party sources in using GPS services within BizBuzz.

12. Legal Compliance

Users agree to use BizBuzz for lawful purposes only and to abide by all applicable laws, regulations, and codes. BizBuzz reserves the right to abide by any court or legislative order requiring release of information and is not responsible for any subsequent or consequential damages to user from such release.

13. Commission Payments

  • Referral Structure: Users can earn commissions based on the net advertising revenues of businesses in their network up to five levels deep. Only users who register via referral links are included in a referrer’s network. Users that receive an invitation link but do not set up an account through this link sent by another user are not part of the other user’s network. If a user received multiple invitations to check out BizBuzz, only the one inviter that their link was used by the new user to fully successfully set up the new user’s personal account would get credit for that user and have that user fall within the inviter’s network. Only one user can be the parent of an individual Level 1 user.

  • Payment Thresholds: Commissions are made available for a monthly payout once a user has accrued $200 or more in earnings, with subsequent payments requiring a minimum of $50 at the time of monthly payouts. Until those thresholds of earnings are reached, the user has not qualified to receive any payments or earnings from BizBuzz and has no ownership in the funds below those amounts and is considered to have zero earnings.

  • Payout Periods for Commissions: BizBuzz payment procedure currently is to have a third party make available commissions for monthly periods for all accounts that have reached the above thresholds on the 5th of each month for the commissions earned in the preceding month. If the 5th of the month falls on a united states federal holiday, Saturday or Sunday, then the next available day the funds should be made available to the user. BizBuzz is not responsible for transfer or payment delays due to banking or financial institution time of delivery requirements. BizBuzz reserves the right to change the payout periods in the future.

  • Third-Party Payment Providers: BizBuzz uses third-party payment services for disbursing funds and is not liable for payment issues, identity theft or any other issues associated with these provider/s. Any concerns or issues regarding receiving funds should be directed to the third-party payment service/s. It is understood that BizBuzz is not responsible for the distribution of the individual payments once BizBuzz has transferred money to the third-party payment service company or has authorized the withdrawal of such funds from BizBuzz to this third-party service. Users are required to completely set up their accounts on the third-party service in order to receive their payments. Any issues with setting up these accounts should be referred back to the third-party service provider.

  • Qualified advertising revenues: Users only earn commissions on those businesses that fall within their 5 levels on qualified advertising revenues of those businesses. Qualified advertising revenues (QAR) are the revenues based only purchases of specific advertising of Job openings, BizBuzz offers and BizCategory Campaigns. Any taxes, regulation fees, app store fees of any kind or commissions, processing fees, credit card fees, business refunds, business discounts, business credits or other associated costs of providing those advertising services is deducted from the advertising revenues to determine the QAR that is to be used in determining the commissions in the network. If any refunds or credits on business purchases occur after distribution of commissions, regardless of reason, BizBuzz reserves the right to reverse commissions or apply a credit against future commissions that would be paid out to a user. Commissions are not paid out or considered QAR on other types of advertising or any membership or verification fees.

  • Non interest and foreign exchange rates: Users are solely responsible for working with the third-party service/s to receive their funds. Users do not receive any interest on unclaimed earnings, commissions or funds and agree to forgo any interest that may or may not be earned to BizBuzz. BizBuzz is not responsible for changes that occur or the timing of payouts in regard to changes in exchange rates for those countries outside of the United States. Any tariffs, other international fees, processing fees, government required withholding or any necessary transactional costs as well as reasonable administrative fee per payment may be deducted from the amount of earnings a user has accumulated.

  • Withholding: BizBuzz will not withhold funds unless specifically mandated or required by a regulatory government agency.

14. Independent Contractor: All users that receive earnings or commissions are completely independent entities or individuals from BizBuzz. The act of users being owed or receiving commissions or referral fees or referring others to BizBuzz does not make these users to be considered employees, investors, shareholders or partners of BizBuzz and are completely considered independent contractors. BizBuzz does not provide any insurance to users and does not provide any legal or accounting advisement. Users are solely responsible for any expenses they may incur in referring others to set up accounts or profiles on BizBuzz. Users are solely responsible and liable for following all tax codes, insurance or business licensing requirements that apply to them and BizBuzz suggests that all users seek their own accounting and legal counsel for any guidance on any matter. BizBuzz or its third-party payment processor may issue a yearly 1099 or other form as required by law or governing agencies and will do so electronically, unless required differently by law, to the contact information that is on file at the time of producing said documents. BizBuzz and/or its third-party processor are not responsible for incorrect contact information, or the improper delivery of said documents and the user is solely responsible to track and report all payments for tax purposes as required by law. BizBuzz in no way guarantees any amount of income to users that refer others, and multiple factors affect the results that any one user can see by referring others to BizBuzz.

15. Payments and Valid Payment Methods and collection of unpaid balances.

Users must maintain valid payment methods for BizBuzz to charge recurring fees or renewals associated with campaigns, job postings or any future membership fees. Users agree that BizBuzz may take actions such as account suspension or legal collection if fees are unpaid on advertising services rendered. Non-payment of advertising services does not release the financial obligation for users and businesses to the advertising services provided. Users also agree that BizBuzz’s discretion and allowed by law, that users will be liable for any collection, legal costs or late fees involved or attached in collecting on past due amounts for services rendered. Advertising done on BizBuzz that is not covered by the user’s payment method on file will be the responsibility of the authorized user that placed that advertising.

16. Verification fee / Use of Payment Method on File

BizBuzz may require a verification fee as one method to help deter non authorized users from claiming businesses that are not theirs. This fee is non-refundable even if the business does not follow through with fully setting up their profile. The payment method used to make this verification fee is stored on BizBuzz or through a third party such as authorize.net. User agrees that any future payments for additional services or renewals will be charged to this payment method and this payment method will be kept on file. Users can change this payment method and can see instructions for this through frequently asked questions. BizBuzz can require a valid payment method be kept on file and only exchanged for another valid payment method.

17. Banning, Temporary/Permanent Removal, and Re-entry Fees

  • Discretionary Removal: BizBuzz reserves the right at their sole discretion to ban users or businesses if they do not align with the platform’s values or community standards. Re-entry fees may apply if BizBuzz allows reinstatement. If BizBuzz deems the business or business location is not real, accurate or in violation of BizBuzz’s policy, BizBuzz may also apply the re-entry fee to another business account of the personal user. Users agree and acknowledge that BizBuzz is not responsible for any consequential damage that may occur from being removed from BizBuzz even if it is later discovered that the user or business was not in violation of BizBuzz’s policies or standards.

  • Prohibited Re-Entry: Users and businesses agree not to attempt to rejoin or become listed on BizBuzz after being banned without BizBuzz’s written consent, such as using other user’s accounts or attempting to manipulate BizBuzz’s system. Any user that helps a banned user in manipulating or working around a ban may be liable to consequences or being banned themselves from BizBuzz.

  • BizBuzz policing: BizBuzz reserves the right to employ or work with current users to help police its app and/or website as well as reserves the right, but not required, to set up policies or pay plans to compensate those assigned users based on a percentage of re-entry fees collected that resulted from proper policing of the BizBuzz or through any other method that BizBuzz deems appropriate. Unless otherwise specifically written out with compensation details to a specific usr, users that help police BizBuzz’s policies should not expect to receive any form of compensation.

18. Discounts or Advertising promotional dollars

BizBuzz from time to time at its own discretion may offer advertising dollars or credits to promote its services. These promotions have zero value to the user except as credits towards actual advertising on BizBuzz as per the terms and conditions of that offer. BizBuzz reserves the right to modify, lessen or eliminate these discounts at any time with no prior notice required.

19. State and other laws: Terms and conditions may be adjusted to be in compliance with appropriate legal and regulatory jurisdictions. Any such adjustment or modification to any part of these Terms and Conditions does invalidate the other terms of this agreement.

20. Child Safety Standards Policy for BizBuzz

At BizBuzz, we wish to provide a safe and secure environment for all users, particularly minors. Our platform connects people and businesses and facilitates communication and interaction, and children under age 13 should be discouraged from using the app.

a). Age Restriction

BizBuzz is intended for users aged 13 and above. Users under the age of 13 are not permitted to create an account or use the app. If we become aware that a user is under the age of 13, BizBuzz reserves the right to immediately suspend and/or remove their account.

b). Data Collection

We do not knowingly collect personal information from children under the age of 13. In the event that we discover that we have inadvertently collected personal information from a child under 13, we will take steps to remove that information promptly and in accordance with applicable laws.

c). Parental Consent

BizBuzz encourages parents and legal guardians to monitor their children’s use of the app. If your child has registered on BizBuzz and you wish to review, update, or delete their information, please do so.

d). Reporting Concerns

If you believe that a child under 13 is using BizBuzz or that a user is engaging in inappropriate behavior involving minors, please report this to us immediately. We will investigate all concerns accordingly. To report a concern, please contact us through our support.

e). User Conduct

Users of BizBuzz must adhere to our Code of Conduct, which includes guidelines to prevent harmful or inappropriate interactions with minors. We do not condone any form of child exploitation, bullying, harassment, or predatory behavior on the platform. Any user found violating these standards will face account suspension or termination.

f). Content Moderation

We employ community involvement and help in the app to monitor content shared on BizBuzz. Content that violates our Child Safety Standards, including explicit material or content that promotes harmful behavior toward minors, will be removed.

g). Compliance with Laws

BizBuzz complies with all applicable child protection laws.

h). Changes to Policy

We reserve the right to modify or update this policy at any time with or without notice to better protect children and ensure compliance with evolving laws and best practice.
